Title 250 Department of Environmental Management
Chapter 120 Air Resources
Subchapter 05 Air Pollution Control
Part 43 Air Pollution Control Regulation No. 43- General Permits for Smaller-Scale Electric Generation Facilities
Type of Filing Direct Final Amendment
Regulation Status Active
Effective 06/06/2025

Regulation Authority:

R.I. Gen. Laws § 42-17.1-2(19)
R.I. Gen. Laws Chapter 23-23
R.I. Gen. Laws Chapter 42-35

Purpose and Reason:

Part 43 currently includes recordkeeping requirements that require a source to determine fuel usage for each distributed generator and/or hours of operation for each emergency generator and record such information no later than five days after the first of each month.  The Department is proposing to eliminate the five day recording requirement and allow the source to record the data at any time during the month.
